Hello guys, I was just wondering if it was against the rules if someone yells they are selling a certain item and they don't even have the item?

Well you wouldn't know until you pm'ed them. I would consider that spam in my books. If you see some noob name selling like a Yellow Partyhat, it's most likely fake and that would be spam.
